HOW TO ENTER

Individuals who conduct a search using the 'Search and Win' search engine located at www.searchandwin.com.au during the relevant promotional period will be eligible to win randomly allocated Instant Win Prizes.

Individuals who are allocated an Instant Win Prize will be notified on-screen before their search results are shown. To claim their Instant Win Prize, individuals who have not already logged in as a registered member of the 'Search & Win' search engine must then either:

Follow the prompts to register as a member; or
If they are already a member, login with their registration details.

Only the first five (5) searches per person per day will be eligible to win an Instant Win Prize.

If a registered member who wins an Instant Win Prize was originally invited by a friend or family member ("Referee") to register via the "Send to a friend" form on the 'Search & Win' search engine, then that Referee will also win the same Instant Win Prize.

TERMS AND CONDITIONS

Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to NSW, ACT, VIC, TAS, NT, WA and QLD aged 18 years or over who have an internet connection capable of accepting cookies or other devices used by the Promoter to track entries and who have a valid email address.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants and Referees (including an entrant's/Referee's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Multiple entries permitted, however, only the first five (5) searches per person per day will be eligible to win an Instant Win Prize, after which any further searches will not be eligible to win an Instant Win Prize.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Instant Win Prizes will be offered under various promotions on the dates advertised on the 'Search and Win' website, during the period commencing 1/3/10 and ending at 11:59pm AEST on 28/2/11.
Instant Win Prizes available to be won (and their values) will be advertised on the 'Search and Win' website from time to time.
Winners will be notified in writing via a message appearing on the screen immediately upon being allocated an Instant Win Prize. Members who win a prize for being a Referee of an Instant Win Prize winner will be notified by email.
Winners' names will be published on the 'Search and Win' website within 30 days of being awarded the prize. In the case of any Victorian residents who are winners of prizes valued at over $250, the winner's name will be published in The Australian with 30 days of being awarded the prize.
The Promoter's decision is final and no correspondence will be entered into.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value for all Instant Win Prizes awarded under these Terms and Conditions (including any bonus prizes awarded to Referees of Instant Win Prizes) will not exceed AUD$50,000 in NSW and AUD$4,600 in ACT.
A draw for any unclaimed prizes, may take place on 21/2/11 at 2pm AEST at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne, VIC 3004, from all registered members as at 31/1/11, subject to any directions from a regulatory authority. Winners' names will be published on the 'Search and Win' website by 28/2/11.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter via the 'Search and Win' website. All entries become the property of the Promoter.

To enter, individuals must visit www.searchandwin.com.au, follow the prompts to register for the Search and Win email newsletter between 16/08/10 and 11:59pm AEDST on 15/02/11. The entrant will automatically receive an entry into the draw.

Entrants will be eligible to automatically receive bonus entries into the draw during the promotional period, for each of the following:

Entrants will be eligible to receive a specified number of entries into the draw for every promotional link clicked on the Search and Win email newsletter. The number of entries corresponding to each promotional link will be specified in the email newsletter.

Entrants will be eligible to receive one (1) entry into the draw by registering to become a member of the 'Search and Win' website.

Individuals who conduct a search using the ‘Search and Win’ search engine may also be randomly allocated bonus entries into the draw during their first five (5) searches each day. Individuals who are randomly selected to receive bonus draw entries will be notified on-screen before their search results are shown. Individuals who have not already logged in must then either register as a member or login to claim the draw entries.

Registered members may also invite friends and family members to register via the “Send to a friend” form on the ‘Search & Win’ search engine, and will receive ten (10) bonus entries into the draw for each friend/family member they nominate who subsequently registers as a member on the ‘Search & Win’ search engine during the promotional period. The operation of the “Send to a Friend” mechanic is subject to the Spam Act 2003. Entrants should only nominate friends and family with whom they have a direct relationship with, and who consent to receiving these types of messages. Entries will not be awarded for nominating a friend/family member who has already registered or received an invitation to register.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Promotion commences 16/08/10 and entries close 11:59pm AEDST on 15/02/11. The draw will take place at Anisimoff Legal, Level 4, 448 St Kilda Road, Melbourne, VIC 3004 on 22/02/11 at 2pm AEST.

The winner will be notified by mail and the winner’s name will be published in The Australian on 08/03/11.

The prize is not transferable or exchangeable and cannot be taken as cash.

A draw for the prize, if unclaimed may take place on 23/05/11, at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner’s name (if any) will be published in the Australian on 07/06/11.
